SECTION-8 COMPANY

A person or an association wants to promote commerce, art, science, sports, education, research, social welfare, religion, charity, protection of environment or any such other object may form a company under section 8 as non profitable charitable company.  

 Company under section 8 of the Companies Act 2013 can not share the dividends to its’ member/share holders. The profit of these companies shall be utilized the promotion of the object of the company.  

The Central Government may, by licence issued in such manner as may be prescribed, and on such conditions as it deems fit, allow that person or association of persons to be registered as a limited company under this section without the addition to its name of the word “Limited”, or as the case may be, the words “Private Limited” , and thereupon the Registrar shall, on application, in the prescribed form, register such person or association of persons as a company under this section.

Charitable Societies and Trust also work in the same manner but the difference only as the company is regulated by the Central Government but the Societies and Trust are the Subject matter of concerned States.

Section – 8 Company may be private Limited or Public Limited.

1. Minimum Two Person for director
2. Minimum Two Persons (as Promoters)

1. Pan Card of each member (Minimum Two members)
2. Coloured Passport size Photo
3. Residence Proof (Electricity bill/ mobile Bill/telephone Bill)
4. ID Proof of each members (Voter I.D./ Driving License/ Bank Statement)
5. Rent/lease /sale deed for registered office and utility bill of the same address

       Documents & Persons for Section -8 Public Company

       No. of persons required:-

1. Minimum Three Person for director
2. Minimum Seven Persons (as Promoters)
   
   Documents Required :-

        1. Pan Card

        2. Coloured Passport size Photo

        3. Residence Proof (Electricity bill/ mobile Bill/telephone Bill)

        4. ID Proof of each members (Voter I.D./ Driving License/ Bank Statement)

        5. Rent/lease /sale deed for registered office and utility bill of the same address
